PART I: BETA STATUS

1.1 Beta Services. THE SERVICES ARE PROVIDED ON A BETA, PRE-RELEASE, OR EVALUATION BASIS. The Services have not reached general availability and may not be suitable for production, mission-critical, or high-risk use.

1.2 Beta Expectations. The Services may: contain bugs, errors, and incomplete features; not function as intended or documented; experience downtime, outages, or data loss; change substantially without notice; lack backward compatibility; have incomplete or inaccurate documentation; and remain in beta indefinitely. NodeFox has no obligation to preserve data, backward compatibility, or any specific behavior across releases.

1.3 No Production Reliance. Do not rely on the Services for production workloads, business-critical operations, regulatory compliance, or any use where failure would cause significant harm.

1.4 Assumption of Risk. YOUR USE IS AT YOUR OWN RISK. You assume all responsibility for evaluating suitability and for all consequences.

1.5 Not for Regulated or High-Risk Use. The Services are not designed for: HIPAA, PCI-DSS, SOX, or GLBA workloads; critical infrastructure or emergency response; medical, legal compliance, or safety-of-life decisions; employment, credit, housing, or insurance decisioning; government classified systems; or other regulated or high-risk environments — unless appropriate independent safeguards are in place and you accept full responsibility.

1.6 Sandbox First. You must test in non-production environments before any production deployment. You are solely responsible for evaluating suitability.


PART II: WARRANTIES AND SERVICE LEVELS

2.1 "As Is." THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

2.2 Disclaimer. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NODEFOX DISCLAIMS ALL WARRANTIES, INCLUDING: merchantability; fitness for a particular purpose; title; non-infringement; uninterrupted, timely, secure, or error-free operation; meeting your requirements; compatibility with any hardware, software, browser, or OS; freedom from vulnerabilities; persistence, integrity, or recoverability of data; accuracy of outputs; conformance to any accessibility standard; and compliance with any law, regulation, or standard.

2.5 No Compliance, Certification, or Framework Guarantee. NodeFox does not represent or warrant that use of the Services alone will satisfy any legal requirement, regulatory obligation, or security framework/certification criteria (including, without limitation, SOC 2, ISO/IEC 27001, PCI DSS, HIPAA, or similar frameworks). You are solely responsible for independent assessment, controls, and validation.

2.3 No SLA. THE SERVICES ARE NOT SUBJECT TO ANY SERVICE LEVEL AGREEMENT, UPTIME GUARANTEE, AVAILABILITY COMMITMENT, PERFORMANCE WARRANTY, OR RESPONSE TIME GUARANTEE. THIS APPLIES TO BOTH FREE AND PAID TIERS. Payment does not entitle you to service level guarantees.

2.4 No Compensation for Downtime. NodeFox is not liable for downtime, unavailability, degradation, or interruptions. Status pages, uptime displays, or usage dashboards are informational only, may be inaccurate, and do not create SLAs or commitments.


PART III: ARTIFICIAL INTELLIGENCE

3.1 AI-Powered Features. The Services include AI-powered functionality, including AI-assisted suggestions, DSL generation, AI-assisted network/Workflow building, and other features that may use third-party AI models. These disclaimers apply to all AI functionality.

3.2 AI Output Limitations. AI-GENERATED OUTPUTS MAY BE: inaccurate (factual errors, hallucinations, false statements); incomplete; biased; misleading; inconsistent (different results for identical inputs — AI is non-deterministic); outdated; inappropriate; harmful if relied upon without verification; fabricated (appearing factual but invented); offensive; or destructive (generating syntactically valid but logically harmful executable code, scripts, or commands — such as data-deletion operations — that may cause severe damage if executed without sandbox testing).

3.3 No Reliance. Do not rely on AI outputs without independent verification. AI outputs are not substitutes for professional judgment.

3.4 Human Oversight. You are solely responsible for reviewing and validating all AI outputs; implementing human oversight; determining suitability; ensuring legal compliance; all decisions and actions based on outputs; and all consequences.

3.5 Human Deployer Accountability. Consistent with applicable law (including AI governance laws), you acknowledge that you, as the human deployer of any Workflow or AI system, bear full legal accountability for all outcomes as if you had personally performed each action. You may not rely on AI autonomy, agent independence, emergent behavior, or lack of control as a basis to shift responsibility to NodeFox, to the maximum extent permitted by law. This applies regardless of foreseeability and even where Workflows operate autonomously.

3.6 AI IP. The intellectual property status of AI-generated content is uncertain and subject to evolving law. NodeFox makes no representations regarding copyrightability, infringement status, or ownership of AI outputs.

3.7 AI Training. NodeFox does not use Customer Data for general-purpose AI model training without consent. This reflects current practices and is not a guarantee of future practices except as required by law. NodeFox may process data for security, abuse detection, and service operations. Third-party AI providers may have different practices — review their terms.

3.8 No AI Warranties. NODEFOX MAKES NO WARRANTIES REGARDING AI OUTPUT ACCURACY, RELIABILITY, SAFETY, LEGALITY, APPROPRIATENESS, OR SUITABILITY. AI FEATURES ARE PROVIDED "AS IS."


PART IV: EXECUTION AND WORKFLOW RISKS

4.1 Stop/Pause Not Guaranteed. IF YOU ATTEMPT TO STOP, PAUSE, OR CANCEL A WORKFLOW EXECUTION, NODEFOX MAY ATTEMPT TO HALT PROCESSING, BUT STOPPING IS NOT GUARANTEED. In-flight operations, third-party API calls, webhook deliveries, and outbound requests may complete after a stop request. You remain responsible for all resulting actions, outputs, and costs.

4.2 Execution Semantics. Workflow executions may be duplicated, reordered, delayed, partially executed, or may fail silently. Exact timing, order, and number of executions are not guaranteed. You must design Workflows with idempotency, bounded loops, rate limits, spend controls, retry limits, approval gates, and appropriate error handling.

4.3 Irreversible Actions. Workflows may interact with external systems and have real-world consequences. Actions taken by Workflows may be difficult or impossible to reverse. NodeFox is not responsible for Workflow outcomes, errors, failures, or unintended consequences.

4.4 Automated Costs. Scheduled or automated Workflows may incur third-party costs with each execution. Costs accrue on attempted, failed, partial, retried, or timed-out runs; after stop/cancel requests; and regardless of outcome. Any cost calculator, token estimate, or dashboard display is informational only. NodeFox has no duty to warn of accruing costs or to prevent spend.

4.5 Algorithmic Trading and Financial Automation. The Services are not intended for high-frequency trading, algorithmic financial execution, cryptocurrency transfers, DeFi operations, or live market orders. NodeFox disclaims all liability for financial losses, missed opportunities, or liquidated assets resulting from Workflow latency, execution failures, logic errors, or partial execution during automated trading.


PART V: THIRD-PARTY SERVICES AND COSTS

5.1 Third-Party Services. The Services enable integration with third-party services, platforms, and APIs not provided by NodeFox.

5.2 Third-Party Disclaimers. NodeFox disclaims all responsibility for third-party services, including their availability, reliability, performance, accuracy, security, data practices, compliance, fees, and any harm they cause. The availability of integrations does not constitute endorsement. Third-party services may change or discontinue without notice. NodeFox may suspend or disable integrations for safety or compliance without notice.

5.3 Third-Party AI Providers. AI providers connected via your API keys are not NodeFox subprocessors. NodeFox facilitates technical integration but does not control providers, review inputs/outputs, or make representations about provider outputs. Data transmitted is subject to providers' terms and may be retained by them. Do not transmit secrets or sensitive data to AI providers unless you intend to disclose them.

5.4 Third-Party Costs. You are solely responsible for all third-party fees (AI providers, API charges, cloud costs, processing fees). NODEFOX HAS NO LIABILITY FOR THIRD-PARTY COSTS. Third-party costs are excluded from any liability caps.

5.5 Third-Party Account Consequences. NodeFox disclaims liability for any suspension, banning, or revocation of your third-party accounts, API keys, or developer privileges resulting from your Workflows triggering third-party anti-spam, rate-limiting, or acceptable use enforcement.


PART VI: MARKETPLACE AND USER CONTENT

6.1 Marketplace. NodeFox does not pre-screen, verify, test, audit, or approve all Marketplace Content. Presence in the Marketplace is not endorsement. NodeFox is not responsible for Marketplace Content quality, functionality, safety, legality, or suitability. No escrow, no continuity, no guaranteed re-download. Any optional scanning does not create a duty or standard of care.

6.2 Marketplace Components. Marketplace Content from third-party Contributors is provided "as is." NodeFox does not audit or guarantee WCAG compliance, security, or compatibility for third-party components. Such content may not work with assistive technologies.

6.3 User-Generated Content. Users are solely responsible for content they create, upload, or generate. NodeFox has no obligation to monitor user content; NodeFox may do so in its discretion, and any monitoring does not create a duty. User content does not represent NodeFox's views. Users must not include secrets, credentials, or personal data of others in published or shared content.


PART VII: HEALTH AND SAFETY — FLASHING CONTENT

⚠ PHOTOSENSITIVE EPILEPSY AND SEIZURE WARNING. CERTAIN FEATURES OF THE SERVICES MAY INCLUDE FLASHING LIGHTS, ANIMATED EFFECTS, VISUAL INDICATORS (INCLUDING NODE EXECUTION/FIRING INDICATORS AND WORKFLOW ACTIVITY ANIMATIONS), OR RAPIDLY CHANGING VISUAL PATTERNS. SUCH CONTENT MAY TRIGGER SEIZURES, MIGRAINES, OR ADVERSE REACTIONS IN INDIVIDUALS WITH PHOTOSENSITIVE EPILEPSY OR SIMILAR CONDITIONS.

If you have a history of seizures, epilepsy, photosensitivity, or neurological conditions, consult a medical professional before use. Discontinue immediately if you experience discomfort, dizziness, altered vision, twitching, involuntary movements, or disorientation.

Assumption of Risk. By using the Services, you acknowledge and assume all risks from animated, flashing, or rapidly changing visual content.

Reduced Flashing/Lighting. NodeFox may offer reduced flashing/lighting or reduced-motion display modes. If available, it is your responsibility to enable them in settings. No guarantee of availability, completeness, or effectiveness. You are responsible for configuring the Services, OS, browser, and assistive technology to meet your needs.

No Medical Advice. Nothing in the Services constitutes medical advice. NodeFox is not a healthcare provider.

Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NODEFOX SHALL NOT BE LIABLE FOR PERSONAL INJURY, SEIZURES, OR ADVERSE HEALTH REACTIONS ARISING FROM VISUAL CONTENT IN THE SERVICES. SOME JURISDICTIONS DO NOT PERMIT EXCLUSION OF LIABILITY FOR PERSONAL INJURY CAUSED BY NEGLIGENCE; THIS LIMITATION APPLIES ONLY TO THE EXTENT PERMITTED.


PART VIII: SECRETS, CREDENTIALS, AND SENSITIVE DATA

8.1 Your Responsibility. You are solely responsible for the security of API keys, passwords, tokens, private keys, and other credentials stored in, transmitted through, or used with the Services.

8.2 Do Not Embed Secrets. Do not include secrets, credentials, or sensitive personal data in: Workflow prompts or DSL configurations; execution logs; screenshots or exports; shared workspaces or collaboration spaces; Marketplace listings, descriptions, or changelogs; support communications or feedback submissions; or any publicly accessible content. If credentials are exposed through any means, you must rotate and revoke them immediately.

8.3 Sharing and Export. You are responsible for redacting sensitive information before sharing logs, exports, screenshots, or workspaces externally. NodeFox is not responsible for credential exposure resulting from your actions.

8.4 Security Aids Are Not Guarantees. NodeFox may provide optional safeguards intended to help reduce cross-site scripting (XSS) risks and accidental API key/credential leakage. These safeguards are assistive only and may not detect or block every unsafe payload, data flow, exfiltration path, or abuse scenario. You are solely responsible for implementing and enforcing your own security controls, including input/output validation, encoding, secrets management, access restrictions, key rotation, and incident response.


PART IX: PROFESSIONAL ADVICE AND INFORMATION

9.1 No Professional Advice. THE SERVICES DO NOT PROVIDE PROFESSIONAL ADVICE OF ANY KIND, including legal, medical, financial, tax, accounting, engineering, therapeutic, regulatory, or compliance advice. For matters requiring expertise, consult qualified professionals. Use of the Services does not create any professional-client relationship.

9.2 No Compliance Solution. The Services are not a compliance solution. You are solely responsible for determining applicability and ensuring compliance with all laws and regulations, including data protection (GDPR, CCPA), industry-specific (HIPAA, PCI-DSS, SOX), export controls, sanctions, AI governance, and internal corporate governance (Shadow IT, DLP, vendor procurement policies).

9.3 Information Accuracy. NodeFox may provide information on its website and in documentation. Such information may contain errors, omissions, or become outdated. NodeFox has no obligation to update. Documentation may not reflect the current state of the Services. Pricing is subject to change; errors may occur. Any reliance is at your own risk.


PART X: DATA, SECURITY, AND PRIVACY

10.1 Data. NodeFox does not guarantee persistence, integrity, availability, or recoverability of any data. You are solely responsible for independent backups. Data retention is not guaranteed. Data exports may be incomplete; you are responsible for verification.

10.2 Security. No system is completely secure. The Services are in beta; security features may be incomplete. NodeFox cannot guarantee freedom from vulnerabilities, prevention of unauthorized access, or absence of breaches. You are responsible for Account security, credential management, and reporting suspected incidents.

10.3 Privacy. Data practices are governed by the Privacy Policy (/legal/privacy). Data transmitted to third-party services is subject to their policies. No anonymization technique guarantees complete anonymity.


PART XI: LOCAL EXECUTION AND HARDWARE

11.1 Local Execution. When the Services execute locally via WebAssembly (WASM) or the Desktop Application, processing occurs on your device. NodeFox is not responsible for interactions with your local hardware, OS, file system, or network.

11.2 Hardware Strain. Complex or resource-intensive Workflows may consume significant CPU, GPU, and memory. NodeFox makes no guarantees regarding local resource optimization and disclaims liability for hardware overheating, battery degradation, thermal throttling, or component wear from sustained local execution.

11.3 User-Agent Overrides. The Platform's visual canvas relies on precise spatial rendering. NodeFox is not responsible for UI degradation caused by OS high-contrast modes, forced custom CSS, dark-mode extensions, or other user-agent interventions.


PART XII: RESULTS, OUTCOMES, AND LIABILITY

12.1 No Guaranteed Results. NodeFox does not guarantee any particular results, outcomes, revenue, savings, productivity, compliance outcomes, or suitability.

12.2 Liability Cap. FOR BINDING LIMITATIONS, SEE THE TERMS OF SERVICE. Generally: paid subscribers — NodeFox Platform Fees paid in the prior 12 months; free/trial/promotional users — $0.00. Third-party costs are excluded from all caps and never recoverable from NodeFox.

12.3 Excluded Damages. NodeFox is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, data loss, business interruption, substitute services, autonomous actions, AI outputs, dropped payloads, runaway costs, or intangible losses — even if advised of the possibility.

12.4 Indemnification. You agree to indemnify NodeFox from claims arising from your use, to the maximum extent permitted by law. For binding indemnification terms, see the Terms of Service.


PART XIII: INTELLECTUAL PROPERTY

13.1 Trademarks. "NodeFox" and the NodeFox logo are trademarks of NodeFox LLC. All other marks are property of their respective owners. Use does not imply endorsement.

13.2 IP Disclaimers. NodeFox makes no warranty that the Services or content do not infringe third-party rights. You are responsible for rights to content you upload. AI-generated content IP status is uncertain (see Part III). The Services may include third-party components subject to separate licenses.


PART XIV: FORWARD-LOOKING STATEMENTS

14.1 The Services, website, and communications may contain forward-looking statements regarding plans, roadmaps, or anticipated features. These are informational only — not commitments. NodeFox has no obligation to develop, release, or deliver referenced features. Plans are subject to change without notice. No obligation to update. Do not rely on forward-looking statements for purchase decisions. Base decisions on currently available functionality.


PART XV: GENERAL

15.1 Informational Only. This Page is informational. Binding terms are in the Terms of Service and applicable agreements.

15.2 Terms Control. In conflict, the Terms of Service control.

15.3 Severability. Invalid disclaimers do not affect the remainder.
